IT IS HEREBY ORDERED AND ADJUDGED that Counts I, II, III, V, and XIII of the
amended complaint are DISMISSED with prejudice. Counts IV, VI, VII, and IX of the
amended complaint are DISMISSED without prejudice for lack of subject-matter jurisdiction.
