CONSENT MOTION FOR EXTENSION OF TIME TO REPLY TO HEARTLAND'S RESPONSE TO FOREST RIVER'S MOTION FOR PARTIAL SUMMARY JUDGMENT

Pursuant for Local Rule 6.1(b), Forest River requests a two day extension of time in which to file its reply to "Heartland's Response to Forest River's Motion for Partial Summary Judgment," DE#142. That reply was originally due on December 27, 2010 and with this motion would be due on December 29, 2010. The additional time is needed because of the intervening holidays, a related filing (DE#149), and other matters involving this lawsuit which have required additional time of the undersigned counsel since the Response was served. On December 27, 2010, as part of a conference call commencing at 2:00 pm with Heartland's counsel of record, David Irmscher and Peter Meyer, the undersigned counsel requested Heartland's consent for this motion, and that consent was given. A proposed form of order is forwarded to chambers concurrently herewith.
