MEMORANDUM OPINION AND ORDER: The Court GRANTS IN PART Defendants' motion for summary judgment 26 with respect to Rodriguez's federal claims (Counts I and II). The Court also DISMISSES Rodriguez's state law claim (Count III), without prejudice.
