REPORT AND RECOMMENDATIONS That 47 The Motion To Pay Settlement Proceeds Into The Court And For Order Of Dismissal Is granted. The deft/third-party defts shall pay the $18,000 by certified check made payable to the Clerk. After the time for objections has expired and if the District Judge has adopted this R&R, the Clerk shall disburse the funds in the manner ordered by the District Judge. The undersign also recommends that the action be dismissed. Any objections to the Magistrate Judge 's R&R shall be filed with the Clerk in accordance with 28 U.S.C. 636(b)(1), and failure to file timely objections w/i the ten days after service shall constitute a waiver of subsequent review absent a showing of good cause for such failure (See Report and Recommendation).
