ORDER granting in part and denying in part 10 Defendant's Motion to Dismiss. (See Order.) The Court further merges Counts I and II into a single statutory claim for product liability under the IPLA but denies the motion to the extent it asser ts Ms. Ganahl has failed to state a claim under the IPLA. As to Counts III, IV, V, and VI Defendants' motion is granted. Assuming a sufficient factual foundation exists to do so, Ms. Ganahl shall have fourteen (14) days to file an amended complaint addressing the deficiencies in these stricken claims.
