ORDER ADOPTING REPORT AND RECOMMENDATION
The Magistrate Judge submitted his Report and Recommendation on Defendant’s Motion
to Dismiss Amended Complaint for Failure to State a Claim (Dkt. 17). The parties were afforded
due opportunity pursuant to statute and the rules of this Court to file objections; none were filed.
The Court, having considered the Magistrate Judge’s Report and Recommendation, hereby adopts
the Magistrate Judge’s Report and Recommendation. Defendant’s Motion to Dismiss (Dkt. 17)
is GRANTED IN PART and DENIED IN PART. Plaintiff’s promissory estoppel claim against
Defendant is dismissed and Plaintiff’s McClanahan claim shall proceed.
