ORDER ADOPTING REPORT AND RECOMMENDATION
The Magistrate Judge submitted his Report and Recommendation on Plaintiff’s Complaint
for Judicial Review. The parties were afforded due opportunity pursuant to statute and the rules
of this Court to file objections; none were filed. The Court, having considered the Magistrate
Judge’s Report and Recommendation, hereby adopts the Magistrate Judge’s Report and
Recommendation. The decision of the Commissioner is REVERSED and REMANDED to the
Agency for further proceedings, as authorized by sentence four of 42 U.S.C. § 405(g).
Nancy A. Berryhill is now the Acting Commissioner of the Social Security Administration. Pursuant to Rule 25(d)
of the Federal Rules of Civil Procedure, Nancy A. Berryhill is substituted for Commissioner Carolyn W. Colvin as
the defendant in this suit.
