Entry Discussing Petition for a Writ of Habeas Corpus and Denying Certificate of Appealability - For the reasons explained in this Entry, petitioner James Wilson's petition for a writ of habeas corpus must be denied and the action dismissed w ith prejudice because it was filed beyond the one-year statute of limitations. In addition, the Court finds that a certificate of appealability should not issue. Wilson has encountered the hurdle produced by the one-year statute of limitations. He has not shown the existence of circumstances permitting him to overcome this hurdle, and hence is not entitled to the relief he seeks. His petition for a writ of habeas corpus is therefore denied with prejudice. Consistent with this ruling, the m otion for relief from judgment, dkt. 22 , notice of complaint, dkt. 23 , and motion for summary judgment, dkt. 25 , are all denied. Judgment consistent with this Entry shall now issue. The Court denies a certificate of appealability. (See Entry.) Copy to plaintiff via US Mail.
