See text of Order. Re spondent shall have sixty days to notify the court and the petitioner whether it will demand a new hearing to determine the penalty for Johnson's convictions or will, instead, withdraw the notice of intent to seek the death penalty and allow the court to set a hearing to impose sentences of life imprisonment without parole on the convictions on Counts 6 through 10.
