See order text for details. Trial on Rattray's an d Mathes's remaining claims shall be consolidated. The current trial date of March 11, 2013, originally set for the retrial of Rattray's damages claims, shall be maintained for the consolidated trial of Rattray's and Mathes's rem aining claims, so that a prompt trial date will be available, if no party seeks certification for interlocutory appeal or if the Eighth Circuit of Appeals declines to hear an interlocutory appeal.
