Riches v. Clinton Doc. 2 Case 4:07-cv-00485-JEG Document 2 Filed 10/24/2007 Page 1 of 6 IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF IOWA CENTRAL DIVISION JONATHAN LEE RICHES©, Plaintiff, vs. HILLARY RODHAM CLINTON and JOHN EDWARDS, Defendants. The Court has received a pro se complaint submitted by an inmate of a federal correctional institution in South Carolina. Beginning April 10, 2006, the filing fee for all civil cases (except habeas actions) is $350. Under the provisions of the Prison Litigation Reform Act, the Court is required to assess and collect an initial partial filing fee of 20 percent of the average monthly deposits to the prisoner account or 20 percent of the average monthly balance of the prisoner account for the past six months, whichever is greater. After paying this initial partial fee, the prisoner must pay 20 percent of each future month's income to the prisoner's account. The agency having custody of the prisoner shall send these payments to the Clerk of Court when the prisoner account has more than $10 in it, until the full filing fee is paid. See 28 U.S.C. § 1915(b). In order to make this assessment, the Plaintiff must submit (1) an affidavit that includes a statement of all assets possessed, (2) a certified copy of the prisoner's account statement for the past six months obtained from the appropriate official at the institution, and (3) an authorization to debit trust account. The Court requires that the appropriate prison official also calculate the initial partial filing fee using the formula described above and attach it to the certified copy of the prisoner account statement. Plaintiff has not paid the filing fee or submitted an application to proceed without prepayment of fees supported by the financial information needed to rule on an application to No. 4:07-cv-00485-JEG PRESCREENING ORDER Dockets.Justia.com Case 4:07-cv-00485-JEG Document 2 Filed 10/24/2007 Page 2 of 6 proceed without prepayment of fees.
