Todd for appropriate resolution pursuant to 28 U.S.C. §636(b)(1)(A). No motions to compel, nor any other motions relating to a discovery dispute, shall be filed unless all counsel involved in such dispute have first conferred as directed by Fed.R.Civ.P. 37(a)(2)(A), and said counsel have then conferred with Magistrate Judge Todd, by telephone conference call, and received his permission to file such motion, with such briefing thereupon as he shall direct by appropriate order. 2) That this matter is also REFERRED to Magistrate Judge Dockets.Justia.com Case 5:07-cv-00029-JMH Document 11 Filed 03/13/2007 Page 2 of 4 Todd for such expedited settlement processes as he shall direct by subsequent order. 3) That all motions to amend pleadings be filed on or before September 1, 2007. 4) 2007. 5) 15, 2008. 6) That reports from parties' expert witnesses That all dispositive motions be filed on or before May That all discovery be completed on or before December 31, pursuant to Rule 26(a)(2) shall be due: from plaintiff by February 1, 2008, from defendant by March 1, 2008; and supplementation of reports shall be due pursuant to Rule 26(2). 7) 2008. 8) That the above-styled cause be, and the same hereby is, That all motions in limine be filed on or before June 18, REFERRED to Magistrate Judge Todd for a pretrial conference at a date, place and time to be determined by him, but not later than at least one week prior to July 14, 2008. 9) That at least one week before Magistrate Judge Todd's pretrial conference, counsel shall: (a) trial; (b) premark and display to opposing counsel all -2file a list of exhibits intended to be used at Case 5:07-cv-00029-JMH Document 11 Filed 03/13/2007 Page 3 of 4 exhibits intended to be used at trial. All objections to the authenticity of the exhibits shall be waived unless raised at the conference; (c) file a witness list with a brief summary of the expected testimony of each witness; (d) file a pretrial memorandum brief containing a succinct statement of the facts of the case, the questions of fact and the questions of law; (e) submit agreed proposed jury instructions to the undersigned's office in Lexington, Kentucky. If the parties cannot agree, they shall submit their proposed instructions to the undersigned's office with supporting authorities. The hard copy of all instructions shall be accompanied by a 3 ½" disk in a format compatible with WordPerfect 6.1 or 8.1, if the same is available to counsel; (f) provide a copy of the exhibit list, witness list and pretrial memorandum brief directly to the undersigned at Lexington, Kentucky, and to opposing counsel; and 10) That the matter be, and the same hereby is, assigned for a final pretrial conference in Courtroom A, at LEXINGTON, Kentucky, on July 14, 2008, at 10:00 a.m. At said conference, the parties shall be prepared to discuss a settlement of the matter. 11) That the above-styled cause be, and the same hereby is, assigned for trial by court at LEXINGTON, Kentucky, on August 12, -3- Case 5:07-cv-00029-JMH Document 11 Filed 03/13/2007 Page 4 of 4 2008, at 9:00 a.m., Courtroom A, United States Courthouse, The take Lexington, Kentucky, subject to intervening orders of Court. parties have advised the Court that this trial shall approximately 4 to 5 days.
