MEMORANDUM OPINION & ORDER: It is ordered, 1) 42 MOTION for Partial Reconsideration shall be DENIED. 2) Plas' 34 Motion for Summary Judgment as to dft Tyler Bowers is DENIED. 3) That the fact that "Tyler Bowers entered into a managem ent agreement with Plas to which he faces liability for breach of contract as he did not disaffirm the contract before the age of majority or within a reasonable time thereafter" is NOT GENUINELY AT ISSUE and SHALL BE TREATED AS ES TABLISHED IN THIS ACTION. 4) This Court shall DISMISS WITH PREJUDICE Plas' claims against Tim and Tyler Bowers under the management agreement to commissions associated w/ Tyler Bowers' earnings in 2007 from One Industries and SHIFT.
