RECOMMENDED DISPOSITION re 1 PETITION to Enforce IRS Summons - Court recommends that District Judge issue an order enforcing the IRS summons at issue in this action; IRS has established its right to enforcement, & respondent has failed to show any cause in avoidance of such relief; District Judge should order respondent appear at particular date & time before Revenue Officer Linda Kennedy to respond in full to summonses previously served; Court further should warn, & Martin must take notice, t hat failure to abide by the order to appear could subject Martin to potential penalties, including contempt of court; Clerk shall serve this Order on all parties, & specifically serve respondent @ 690 Gingermill Ln, Lex, KY; Court directs partie s for appeal rights & mechanics concerning this Recommended Disposition; w/in 14 days after being served w/copy of this decision, any party may serve & file specific written objections to any or all findings or recommendations for determination, de n ovo, by District Court; failure to make timely objections consistent w/statute & rule may result in waiver of further appeal or review by District Court & Court of Appeals.
