MEMORANDUM OF CONFERENCE AND ORDER by Judge David J. Hale. A teleconference having been conducted and the Court being otherwise sufficiently advised, it is ORDERED that the portion of this Court's Memorandum and Order to Stay and Hold in Abeyanc e (D.N. 100) requiring Petitioner to file status reports on the state proceedings every 90 days is SUSPENDED. However, the portion of the Court's Order (D.N. 100) requiring Petitioner to notify this Court no later than 21 days after exhausting h is state-court remedies remains in effect. A telephonic status conference is SET for July 11, 2016, at 10:00 a.m. The Court will initiate the call. Barron Jon P. Sheldon For Respondent: Jason B. Moore During the conference, counsel discussed the parallel posture of the instant action with the pending state-court actions, the delay which may have occurred in state court due to the possibility of a settlement between the parties, and the likelihood of an evidentiary hearing in state court. Accordingly, and the Court being otherwise sufficiently advised, it is hereby ORDERED as follows: (1) The portion of this Court’s Memorandum and Order to Stay and Hold in Abeyance (D.N. 100) requiring Petitioner to file status reports on the state proceedings every ninety (90) days for as long as the stay is in effect is SUSPENDED. (2) However, the portion of the Court’s Order (D.N. 100) requiring Petitioner to notify this Court no later than 21 days after exhausting his state-court remedies remains in effect. (3) A telephonic status conference is SET for July 11, 2016, at 10:00 a.m. The Court will initiate the call. Participating counsel shall contact Judge Hale’s Case Manager, Natalie Thompson at NThompson@kywd.uscourts.gov with their preferred contact numbers by July 6, 2016.
