MEMORANDUM OPINION AND ORDER signed by Judge John G. Heyburn, II on 2/17/2011. Plaintiff's motion for leave to file it First Amended Complaint is SUSTAINED and the First Amended Complaint is ORDERED FILED. The motion of Defendants to dismiss the complaint is DENIED at this time. The Court will reconsider the decisions in Section II of the Memorandum at a later date. For now, parties are to file an agreed litigation plan. Upon completition, the parties should contact the Court's Deputy, who will schedule a court conference to discuss these and other issues in the case. cc: Counsel (AEP)
