MEMORANDUM OPINION AND ORDER by Judge David J. Hale on 3/28/2018. Defendants motion to dismiss the class allegations (D.N. 5 ) is DENIED. Defendants motion to strike Plaintiffs attachment (D.N. 9 ) is DENIED without prejudice. Defendants motion for an extension of time to file their answer to Plaintiffs complaint (D.N. 6 ) is DENIED as unnecessary. Plaintiffs motion for a hearing (D.N. 7 ) is DENIED without prejudice. Plaintiffs motion for leave to file a second amended complaint (D.N. [ 8]) and motion for a status conference (D.N. 15 ) are GRANTED. Plaintiffs shall have fourteen (14) days from the date of entry of this Order within which to file an amended complaint. Defendants shall have fourteen (14) days thereafter in which to f ile their answer to Plaintiffs second amended complaint. This matter is REFERRED to U.S. Magistrate Judge Dave Whalin for resolution of all litigation planning issues, entry of scheduling orders, consideration of amendments thereto, and resolution of all non- dispositive matters, including discovery issues. Judge Whalin is further authorized to conduct a settlement conference in this matter at any time. cc:counsel (MEJ)
