MEMORANDUM OPINION by Judge Joseph H. McKinley, Jr on 12/30/10; Plaintiff's claim against Tatem in her official capacity will be dismissed. The Claim against DCDC will also be dismissed for failure to state a claim. The court will enter a separa te Scheduling Order governing the development of Plaintiff's indicidual- capacity claim against Defendant Tatem which will be permitted to proceed and will enter a separate Order dismissing all other claims. cc:counsel, Plaintiff (pro se), Defendant, DCDC (JBM)
