R. Civ. P. 60(b)(2), (6) and 62.1(a)(3), Defendant-Intervenors respectfully move for relief from this Court's June 22, 2010 Preliminary Injunction Order (Docs. 67 & 68). As grounds for their Motion, Defendant-Intervenors state: 1. Newly discovered evidence shows that the Preliminary Injunction Order must be vacated; 1 2. The facts set forth in the Defendant-Intervenors' Motion For Disqualification (filed July 2, 2010) justify relief; and, 3. Although the Court of Appeals has jurisdiction over the Preliminary Injunction Order, this Court has authority to indicate that it would vacate that order upon remand pursuant to Fed. R. Civ. P. 62.1(a)(3). Wherefore: This Court should indicate that it would GRANT the instant motion and vacate the Preliminary Injunction order upon remand.
