NOTICE OF FILING OF CD-ROM IN RESPONSE TO REQUEST FOR SUPPLEMENTAL BRIEFING AND MATERIALS In accordance with the Court's Order dated August 17, 2010, and pursuant to the Court's Unique Procedures and Practices for Electronic Filing, Defendants hereby give notice of the filing of a CD-ROM containing each of the documents listed in the Response Index, which Defendants submitted as Exhibit 1 to the Declaration of Jamie L. Burley, Dkt. #158-1. As Defendants indicate in their Supplemental Briefing in Support of Defendants' Motion to Dismiss, see Dkt. #158 at 11, the CD-ROM is provided for the convenience of the Court and in further response to the Fifth Circuit Court of Appeal's August 16, 2010, Limited Remand Order. Due to the voluminous size of the documents contained in the CD-ROM (6,082 pages), the documents cannot be filed electronically through the Court's CM/ECF system. A CD-ROM

containing the documents will therefore be delivered to the Clerk of the Court via Federal Express for delivery on August 25, 2010. Service copies will be provided to all parties.
