Kenneth Lee Salazar, in his official capacity as Secretary of the Interior; the United States
Department of the Interior; Michael Bromwich, in his official capacity as Director of the Bureau
of Safety and Environmental Enforcement; and the Bureau of Safety and Environmental
Enforcement,1 hereby appeal to the United States Court of Appeals for the Fifth Circuit from this
Court’s August 4, 2010, Judgment (Dkt. #280).

The Bureau of Ocean Energy Management, Regulation and Enforcement (BOEMRE) was
established to perform certain responsibilities of the former Minerals Management Service. On
October 1, 2011, BOEMRE was further divided into the Bureau of Ocean Energy Management
and Bureau of Safety and Environmental Enforcement; the latter’s authority is relevant to
Plaintiffs’ complaint. Pursuant to Rule 25(d) of the Federal Rules of Civil Procedure, Michael
Bromwich is substituted for Robert Abbey, who was the Acting Director of the Minerals
Management Service at the time Plaintiffs filed their complaint.
