Magistrate Judge’s Report and Recommendation and adopts it as its opinion.
Accordingly, plaintiff’s motion for summary judgement is DENIED,
defendant’s motion for summary judgment is GRANTED, and plaintiff’s case
is DISMISSED WITH PREJUDICE.
