ORDER: IT IS HEREBY ORDERED that Defendants Sheriff Marlin Gusman, Captain Sidney Holt, and Corey Amacker's 25 Motion to Dismiss is GRANTED, in part, to the extent that Plaintiff's Section 1983 claim based on respondeat superior liability are hereby DISMISSED. IT IS FURTHER ORDERED that the 25 Motion to Dismiss is DENIED as to all other claims at this time. IT IS FURTHER ORDERED that Plaintiff is granted leave to file a Rule 7(a)(7) reply as to Plaintiff's Section 1983 claims against DOC Defendants in their individual capacities and to amend the complaint within fourteen days of this Order to cure the deficiencies noted, if possible.
