RULING: The motions by deft J.E. Merit Constructors, Inc. for summary judgment (docs. 66, 67, 68, 69, 70, 71, 72, 73, 74, 75, 76, 77, 78, 79, 80 and 81) are DENIED only insofar as deft seeks to preclude the Court's consideration of the failure t o promote claims of any pltf that arose from Jacobs' failure to promote after 12/1/2006, and are GRANTED in all other respects.
