RULING Adopting 17 Report and Recommendations of the U.S. Magistrate Judge. The court decline to exercise supplemental jurisdiction and that the defendants 13 Motion to Dismiss is granted in part, in that the plaintiffs claim for monetary damages against the defendants in their official capacities are dismissed, and denied in all other respects, and this matter is referred back to the US Magistrate Judge for further proceedings.
