OPINION Adopting 55 Report and Recommendations of the U.S. Magistrate Judge man. The 41 motion for partial summary judgment shall be granted, dismissing the pla's claims against dfts Richard Stalder, Burl Cain, Dr. Huffman and Dr. Sylvester, and dismissing the pla's claim of an alleged denial of medication for failure to exhaust administrative remedies as mandated by 42 U.S.C. § 1997e. It is further ordered that the 40 motion to dismiss the remaining dfts shall be granted, dismissing the pla's claims, with prejudice, and that this action be dismissed.
