Defts 10 Motion for Partial Dismissal is GRANTED, dismissing pltfs claims against defts Roger Young and Burl Cain in their official capacities, with prejudice, and dismissing the pltfs claims asserted against deft Burl Cain, with prejudice, on the basis of qualified immunity, and this matter is referred back to MJ Noland for further proceedings.
