RULING Adopting 17 Report and Recommendations of the U.S. Magistrate Judge. The defendants' motion to dismiss, rec.doc.no. 13, is granted, dismissing the plaintiff's claims against defendant Joseph Shorts for failure of the plaintiff to s erve this defendant within 120 days as mandated by Rule 4(m) of the Federal Rules of Civil Procedure. Further, defendants' Motion for Summary Judgment, rec.doc.no. 14, will be granted, dismissing the plaintiff's claims against the remaining defendants, with prejudice, and that this action will be dismissed..
