OPINION Adopting 7 Report and Recommendations of the U.S. Magistrate Judge regarding the 2 Motion to Remand filed by Sherman J. Augustine. The Court finds that the Motion to Remand is DENIED. However, the Court in the exercise of the discretion provided to the Court under 28 USC 1367 refuses to hear the state law claims. Therefore, the state court claims are remanded to state court.
