RULING Adopting 25 Report and Recommendations, 28 Report and Recommendations of the U.S. Magistrate Judge. Accordingly, the motion to dismiss filed by defendants Kevin Benjamin, Phillip Causey, Jimmy Smith, and Kenneth Wilson is granted and this action is hereby dismissed. The claims against defendants Charles Daniels and Robert Skipper are dismissed as frivolous pursuant to 28 U.S.C. § 1915 (e) (2) (B) (I) and without prejudiceto any state law against them.
