RULING Adopting 42 Report and Recommendations of the U.S. Magistrate Judge regarding 33 and 18 Motions for Partial Summary Judgment filed by defts. The pltfs claims asserted against Joshua Mabus are dismissed, without prejudice, for failure of the plaintiff to serve this defendant within 120 days as mandated by FRCP Rule 4(m). The Motions for Summary Judgment of defendants Daryl Vannoy, Chad Menzina, Greg Foster and Kenneth Harris (docs. 18 and 33) are granted, dismissing the plaintiff's claims asserted against these defendants, with prejudice.
