RULING and ORDER OF DISMISSAL approving the 32 Report and Recommendation of the U.S. Magistrate Judge and adopting it as the court's opinion herein. Accordingly, the Court declines to exercise supplemental jurisdiction over the Plainti ff's state law claims. Further, Defendants' 19 Motion to Dismiss is granted, dismissing Plaintiff's claims asserted against Defendants, with prejudice, for failure to state a claim upon which relief may be granted.
