RULING adopting 19 Report and Recommendation of the U.S. Magistrate Judge DISMISSING claims against "Care Provider Moore" without prejudice for failure of the plaintiff to serve this defendant within 120 days as mandated by Fed.R.Civ.P . 4(m). The Court declines to exercise supplemental jurisdiction over the state law claims and the 15 Motion to Dismiss Jim Rogers for Failure to State a Claim is GRANTED, with prejudice, for failure to state a claim upon which relief may be granted.
