RULING AND ORDER granting in part and denying in part 90 Motion for Summary Judgment. The motion is GRANTED with respect to Plaintiff's claims for compensatory damages under 42 U.S.C. § 1983. without prejudice to any state law claim. The motion is DENIED AS MOOT wit h respect to Plaintiff's state law claims in light of the Court's decision to decline exercise of supplemental jurisdiction. The motion is DENIED in all other respects. Plaintiff's claims for compensatory damages arising under 42 U.S.C. § 1983 are DISMISSED WITH PREJUDICE and Plaintiff's state law claims are DISMISSED WITHOUT PREJUDICE.
