RULING and ORDER OF DISMISSAL: The Court adopts the 24 Report and Recommendation of the U.S. Magistrate Judge. The Defendants' 9 Motion for Summary Judgment is GRANTED. The claims against Sgt. Harris, Capt. Smith and Capt. Williams are dismi ssed for failure to prosecute pursuant to Rule 4(m), Fed.R.Civ.P. Further, the Court declines to exercise supplemental jurisdiction over any state law claim. Therefore, the Complaint is dismissed without prejudice to any state law claim. Signed by Judge Shelly D.
