RULING Affirming and Adopting the 20 Report and Recommendation of the U.S. Magistrate Judge. The Court GRANTS IN PART the defendant's 14 Motion for Partial Summary Judgment and thus (1) DISMISSES all claims against Warden Burl Cain an d Camp C Warden Tim Delaney WITH PREJUDICE, and (2) DISMISSES all claims against Major Phillip Maples, except for the plaintiff's excessive force claim WITH PREJUDICE. The Court DISMISSES the claims against Captain Wells and the Louisiana Department of Public Safely and Corrections. The Court REFERS the case back to the Magistrate Judge for further proceedings.
