RULING granting 23 Motion to Dismiss. The state law negligence claims against T. Baker Smith are dismissed with prejudice. Defendants Kenneth W. Smith, Jason Kennedy and Annette Huber, are hereby dismissed from this action with prejudice, as the state law negligence claims are the only claims brought against these Defendants.
