RULING Adopting 19 Report and Recommendation of the U.S. Magistrate Judge. The Court concludes that Defendant Dow has satisfied its heavy burden, by clear and convincing evidence, that there is no reasonable basis for the district court to predict that the Plaintiff might be able to recover from any of the Louisiana Officer-Defendants in their individual capacity under Louisiana law. Because these Louisiana Officer-Defendants were improperly joined, their citizenship shall be disregarded. There is complete diversity of citizenship between the Plaintiff and other Defendants.
