RULING and ORDER adopting 148 Report and Recommendation of the U.S. Magistrate Judge. The Defendant's 61 Motion for Summary Judgment and 132 Motion for Summary Judgment are DENIED. Plaintiff's claims against the Defendants, "Jo hn Doe" medical providers, are DISMISSED for Plaintiff's failure to identify and serve these Defendants within the time allowed by Rule 4(m) of the Federal Rules of Civil Procedure.
