RULING and ORDER: Defendant's Motion for Partial Summary Judgment (Doc. 14) is GRANTED IN PART AND DENIED IN PART. The Court finds that Plaintiffs charge of discrimination was timely filed and that she properly exhausted her administrati ve remedies prior to filing this action. However, the Court also finds that Plaintiffs claim of racial discrimination under 42 U.S.C. § 1981 is barred by the sovereign immunity doctrine. IT IS FURTHER ORDERED that Defendant's Motion for Partial Summary Judgment (Doc. 18) is DENIED. Plaintiffs Title VII gender and/or race discrimination claims survive. Signed by Chief Judge Brian A.
