RULING AND ORDER: both parties shall, within seven days from the date ofthis Order, brief the Court regarding whether Dr. Dammers' failure to comply with the Rule 26 disclosure requirement is "substantially justified or is harmless," a s per the four factors considered by the Fifth Circuit in Sierra Clnb, Lone Star Chapter V.
