RULING and ORDER: The 5 Motion to Dismiss Pursuant to Rule 12(b)(6) is denied without prejudice, to be reasserted, if SOREC so chooses, in response to Duhon's amended complaint. Duhon's amended complaint shall be filed on or before 5/28/ 15. Should SOREC choose to re-file a motion to dismiss pursuant to Rule 12(b)(6), it shall do so no later than 6/18/15. Any amended motion to dismiss filed by SOREC must be complete in itself and must not incorporate by reference any prior pleading.
