RULING and ORDER adopting 59 Report and Recommendation of the U.S. Magistrate Judge. Defendants' 48 Motion for Summary Judgment is GRANTED, and Plaintiff's 51 Cross Motion for Summary Judgment is DENIED. Plaintiff's 42 USC 1983 claims against Defendants are DISMISSED WITH PREJUDICE.
