RULING and ORDER: The 11 Motion for Summary Judgment for Failure to Exhaust Administrative Remedies filed by Defendant is GRANTED in part and DENIED in part. The motion is DENIED with respect to Plaintiff's failure to train claim against Def endant under 42 U.S.C. § 1983. The Motion is GRANTED with respect to Plaintiff's remaining claims against Defendant under 42 U.S.C. § 1983, without prejudice to any state law claim.
