RULING AND ORDER Adopting 51 Report and Recommendation of the U.S. Magistrate Judge. The claims brought by Plaintiff against Burl Cain are DISMISSED WITHOUT PREJUDICE. Defendants' 43 Amended Motion to Dismiss is GRANTED IN PART, to the ex tent that Plaintiff's claims against Defendants in their official capacities for monetary damages, Plaintiff's claims against James LeBlanc, and Plaintiff's claims against Derek Jones for failing to intervene in the attach are DISMISSED WITH PREJUDICE.
