RULING adopting the 47 Report and Recommendations of the Magistrate Judge. The 12 Motion to Dismiss is GRANTED . Plaintiff's claims are dismissed against Defendant in his official capacity. It is further ordered that the Parties' 18 , 31 Cross-Motions for Summary Judgment are denied and this matter is referred back to the Magistrate Judge for further proceedings.
