RULING AND ORDER granting Defendant's 5 Motion to Dismiss for Failure to State a Claim and 6 Motion for Summary Judgment. Plaintiffs claims against Warden Tanner,Warden McCain, and Secretary Leblanc in their official capacities are DISMI SSED. Plaintiffs claims against LDPSC are DISMISSED. Plaintiffs unconstitutional policies and procedures claims and failure to train and supervise claims against Warden Tanner, Warden McCain, and Secretary Leblanc are DISMISSED. Plaintiff's 42 U.S.C. § 1983 claims against Warden Tanner in his individual capacity are DISMISSED. Plaintiff's § 1983 claims against Warden McCain in his individual capacity are DISMISSED with PREJUDICE. Plaintiff's§ 1983 claims again st Secretary LeBlanc in his individual capacity are DISMISSED with PREJUDICE.
