RULING AND ORDER : The 13 Motion to Dismiss the Defendant's Counterclaims is GRANTED. Counterclaims V and VI brought against Plaintiff are DISMISSED. Defendant's 13 Request for Leave to Amend Counterclaims is DENIED WITHOUT PREJUDIC E. Plaintiff's 19 Motion for Summary Judgment on Choice of Law is GRANTED. Counterclaims I, II, and III are DISMISSED. The Joint 30 Motion for Status Conference with District Judge, in which the parties seek a status conference before the Court to discuss amending the Scheduling Order is DENIED.
