JUDGMENT ADOPTING 43 Report and Recommendations in re 32 Motion for Summary Judgment filed by USA. ORDERED defendants' motion be GRANTED and Weathington's action pursuant to the Federal Tort Claims Act is DENIED AND DISMISSED WITH PREJUDICE. The previous judgment of 2/11/10 is also corrected to reflect dismissal of plaintiff's Bivens claims instead of the misnomer "civil rights" claim. Signed by Judge Dee D Drell on 06/27/2011.
