REPORT AND RECOMMENDATIONS re 1 Complaint RECOMMENDING that Peters' civil rights complaint be DISMISSED WITH PREJUDICE for failing to state a claim for which relief can be granted pursuant to 28 USC Section 1915(e)(2)(B). Peters may file a pe tition for habeas corpus after exhausting the proper remedies. Peters' claim for monetary damages should be DISMISSED WITH PREJUDICE to be asserted again until such time as the Heck conditions are satisfied. Objections to R&R due by 1/25/2010.
